Terms & Conditions
1.1. These General Terms and Conditions, hereafter referred to as the "GTC," are applicable to all contracts entered into by a consumer or entrepreneur, hereinafter referred to as the "Customer," with hospitals, clinics, health centers, beauty centers, doctors, and similar healthcare institutions, organizations, and individuals providing the services requested by the Customer, hereinafter referred to as "medical service providers." These contracts concern the goods and/or services presented on the Internet portal and online shop, https://www.europehealthagency.com, and are established through orders placed via the website of the Intermediary, telephone, or various digital platforms such as e-mail, WhatsApp, or any other messaging system.
The Intermediary reserves the right to modify these GTC, either wholly or partially, without prior notice, provided it serves the interests of the Customer, in response to new legal circumstances.
1.2. These GTC apply to all services offered by the Intermediary on its internet portal, https://www.europehealthagency.com, and online shop, mediated through orders placed via the Intermediary's website, e-mail, WhatsApp, telephone, or any other messaging system.
Use of the Website and Intermediary Services
To utilize the Intermediary's website and its services through e-mail, WhatsApp, telephone, or any other messaging systems, as well as to access the goods and/or services offered there, the Customer must be of legal age, legally competent, and, within the framework of the applicable jurisdiction, authorized to conclude contracts and transactions with third parties.
The use of the Intermediary's website and the goods and/or services offered here by underage Customers who do not meet the aforementioned conditions is void from the outset.
The Intermediary reserves the right, at its own discretion and without the obligation of further explanation or individual notification, to terminate contracts with individuals who do not meet the specified criteria.
The Intermediary shall not be responsible or liable in any manner for any damage arising from the unauthorized use of the website or the use of the website by unauthorized persons. Claims for damages against the Intermediary by the legal representative of the offender are preemptively excluded.
Conclusion of the Contract
3.1. The product descriptions in the Intermediary's online shop do not constitute binding offers on the part of the Intermediary.
These descriptions are a selection of offers presented by medical service providers and published by the Intermediary. The offers are primarily based on information provided by medical service providers and other third parties, though not limited to them.
It is expressly stated that no contractual relationship is established between Europe Health Agency and the Customer. Instead, the Customer enters into a contract with the medical service providers.
Europe Health Agency merely conveys the offers made and prepared by the medical service providers. In no way does the Intermediary guarantee or assume liability for the offers made by the medical service providers, the services contained therein, the fulfillment of these services, or their quality.
3.2. The Intermediary may present an offer through the integrated online order form on its online shop. In doing so, after the Customer has placed the selected services in the virtual shopping cart, proceeded through the ordering process, and clicked the button to finalize the order, the Intermediary makes a contractual offer regarding the goods and/or services included in the shopping cart.
3.3. When an offer is made through the Intermediary's online order form, the text of the contract is stored by the Intermediary upon conclusion of the contract and transmitted to the Customer in written form (e.g., e-mail, fax, letter, and other electronic message transmission systems) after the order is submitted. Apart from this, the Intermediary does not make the text of the contract accessible.
3.4. Order processing and communication generally occur through e-mail, WhatsApp, telephone, and automated order processing. The Customer must ensure the accuracy of the e-mail address provided for order processing, allowing Europe Health Agency's e-mails to be received at this address. Specifically, if SPAM filters are employed, the Customer must ensure that all e-mails sent by the Intermediary or third parties commissioned by the Intermediary to process the order can be delivered.
Process & Payment
4.1. Upon the Intermediary's response to the Customer's request and the Customer's decision to accept one of the offers provided by the medical service providers, a contract is formed between the Customer and the medical service provider.
The Customer is strongly advised to thoroughly review the terms and conditions and consent forms of the medical service provider before commencing, continuing, or discontinuing any treatment.
4.2. By accepting these General Terms and Conditions, the Customer explicitly states that the Intermediary has informed them of these facts before concluding the contract with the medical service provider, and they are aware of, understand, and accept the contractual relationship.
Claims for losses, damages, recourse, compensation for pain and suffering, or other actions and claims arising from the contractual relationship with the medical service provider can only be directed at the medical service provider. The Intermediary is exempt from any liability.
4.3. The payment of the amount resulting from the contract with the medical service provider is to be made directly by the Customer to the medical service provider, not to the Intermediary.
In exceptional cases, where it is absolutely necessary to guarantee a pre-arranged appointment with the medical service provider and facilitate the smooth handling of the process, the Intermediary may agree to accept a deposit from the Customer. Upon receipt, the Intermediary will promptly forward this deposit to the medical service provider. Subsequent settlement will be conducted between the Customer and the medical service provider.
Electronic Distance Selling / Distance Selling
5.1. This contract concerns the rights and obligations of the parties under the provisions of the Directive on the Methods and Principles of Distance Contracts under the Consumer Protection Act. It pertains to the intermediation of medical services and products provided by the Intermediary to the Customer through electronic channels at https://www.europehealthagency.com.
5.2. The Customer acknowledges having read and understood all preliminary information regarding mediated medical services and/or goods, sales prices, and methods of payment. They have provided the necessary confirmations electronically or in writing in advance.
5.3. The Customer is responsible for ensuring that the e-mail address provided for order confirmation and processing is accurate, allowing e-mails sent by the Seller to be received. In particular, the Customer must ensure that e-mails from the Seller are not blocked by spam filters.
5.4. If the Customer's bank or financial institution is unable to make the service fee payment to the Intermediary due to unauthorized or unlawful use of the Customer's credit card by third parties, not attributable to the Intermediary's error, the Customer shall be liable for the service fee as well as any resulting damages.
Liability
6.1. https://www.europehealthagency.com is an internet portal providing information about medical services and their providers. By using the website and the online shop, the Customer gains access to information regarding medical service providers such as hospitals, clinics, and doctors.
https://www.europehealthagency.com does not assign a specific medical service provider to the Customer. Instead, it compiles a selection from which the Customer can choose the most suitable medical service provider based on their specific needs and desired treatment, make an appointment, and initiate treatment.
All information provided by the Intermediary on its website or in its online shop is supplied by the medical service providers themselves and is presented by the Intermediary within its internet offer and online shop, https://www.europehealthagency.com.
6.2. As an intermediary, https://www.europehealthagency.com does not operate or control any healthcare facilities or services provided by them.
6.3. https://www.europehealthagency.com cannot guarantee or assume any liability for the accuracy, correctness, or timeliness of this information in any way. https://www.europehealthagency.com cannot be regarded as a recommendation or endorsement of the quality of services or the specialization of healthcare providers.
Any liability on the part of the Intermediary for inaccuracies in information, incorrect or incomplete product descriptions, outdated or incorrect information from or about medical service providers, as well as any direct or indirect, present or future consequences arising from the aforementioned points, is excluded.
By accepting these GTC, the Customer confirms their awareness of the exclusion of liability, having been informed about it prior to entering into the contract or purchasing a product and/or service offered in the Intermediary's online shop. The Customer agrees to accept the exclusion of liability and cannot assert any claims against the Intermediary in this regard, either presently or in the future.
6.4. It is explicitly stated that the Intermediary is not a provider of medical services but solely acts as an intermediary between the Customer and the medical provider. The Intermediary is not responsible for the provision of medical services, is not a provider or operator of medical products and services, and bears no liability for them.
6.5. The information provided by the Intermediary on its internet portal, including but not limited to information provided by medical providers and other third parties, as well as any information provided to the Customer before, during, or after the purchase of any products and services offered on the internet and online shop, https://www.europehealthagency.com, by telephone, electronically, by e-mail, or through any other information channel, cannot be considered proper medical advice or medical examination. It cannot in any way replace a thorough examination and consultation with a medical practitioner, nor can it serve as the sole basis for making decisions regarding medical treatment, its continuation, or discontinuation.
6.6. Certain goods or services presented on the Intermediary's website may be prohibited in certain countries. The Customer is solely responsible for ensuring that their actions comply with the laws of the country in which they reside or are a citizen. The Intermediary is under no obligation to provide country-specific information and assumes no liability in the event of the Customer's violation of country laws.
6.7. In the event of treatment, no contract is formed between the Intermediary and the Customer. Instead, a contractual relationship is established between the Customer and the medical service providers. The Customer is solely responsible for monitoring and verifying contracts and consent forms signed with the medical service providers, including but not limited to doctors, hospitals, and clinics. The Intermediary has no medical qualifications and is not responsible or liable for medical procedures performed by the chosen medical service provider.
6.8. The Intermediary shall not be responsible or liable for any treatment, surgery, or other services provided by the Medical Provider, nor shall the Intermediary be liable or responsible for any malpractice claims that may arise directly or indirectly, presently or in the future, from the Medical Provider's advice, applications, surgeries, or other services provided.
6.9. The Intermediary accepts no responsibility or liability for any complications, misunderstandings, dissatisfactions, complaints, or similar issues arising from treatments provided by the Medical Provider. The Customer is strongly advised to carefully review the medical provider's terms and conditions and consent forms before commencing, continuing, or discontinuing any treatments.
By accepting these GTC, the Customer agrees not to hold the Intermediary accountable for any malpractice or complications caused by the medical provider.
Cancellation Right
7.1. The Customer has the right to cancel all goods and/or services purchased through the Intermediary's website or online shop up to 72 hours before the agreed-upon date, without any restrictions.
7.2. To exercise the right of withdrawal, the Customer must notify the Intermediary via e-mail at the address info@europehealthagency.com.
7.3. To meet the withdrawal deadline, it is sufficient for the Customer to send their withdrawal notice before the withdrawal period expires.
7.4. The Intermediary provides intermediary services to the Customer and reserves the right to cancel, either within or outside the cancellation periods mentioned in section 7.1, in cases of discrepancies, incorrect or false information, potential adverse effects on the Customer's health, and similar reasons.
7.5. Damages incurred by the Intermediary and the medical service provider due to cancellations by the Customer, for reasons other than force majeure and outside the periods referred to in section 7.1, shall be fully borne by the Customer.
Period of Validity
8.1. Medical Services and Products are only valid on the dates agreed upon by the Customer and the Medical Provider. Dates may be altered by mutual agreement between the Customer and the Medical Service Provider.
Unilateral requests for date changes and material damage that may result from non-compliance with the availability of the other party shall be borne by the party requesting the date change.
Prices and Terms of Payment
9.1. Unless otherwise stated in the Intermediary's product description, the quoted prices are inclusive of statutory VAT.
9.2. Payment can be made through one of the methods specified in the online shop and the Intermediary's confirmation letter.
9.3. If advance payment by bank transfer has been agreed upon, payment shall be due immediately upon conclusion of the contract unless the parties have agreed upon a later due date.
9.4. No guarantee is provided for the existence and delivery of products and services for which no contract is concluded between the Customer and the medical service provider.
Applicable Law
10.1. All legal relationships between the parties shall be governed by the laws of the Republic of Turkey, excluding the laws on the international sale of movable goods.
Jurisdiction
11.1. Any dispute arising from this contract between the Intermediary, the Customer, and the Medical Provider shall fall within the jurisdiction of the courts of the Republic of Turkey in Istanbul.

Limitation of Liability, Compensation
13.1. By using the Website, its portals, and services, you expressly acknowledge that you understand and accept full responsibility for all risks arising directly or indirectly from your use of the Website.
13.2. https://www.europehealthagency.com and its employees, management, affiliates, and agents shall not be responsible for any failure or shutdown of the Website resulting in the loss of business, profit, or other financial losses due to any claim, loss, petition, action, or other event arising from or related to the validity of these Terms of Use. This includes, without limitation, navigation on the Website, use of the Website, access to or sharing of any files on the Website.
This also applies in cases where https://www.europehealthagency.com has been informed of the theoretical possibility of such damages, regardless of whether the event occurs and the damages arise due to infringement of intellectual property or other property, violation of rights, negligence, contractual liability, or other similar circumstances.
13.3. https://www.europehealthagency.com is not responsible for the accuracy, completeness, or timeliness of any information provided by suppliers and/or other third parties on the Website.
13.4. The Website may contain links to third-party websites, provided solely for the convenience of the User. https://www.europehealthagency.com shall not be liable for any direct or indirect damage or loss arising from visiting https://www.europehealthagency.com or using services provided by third-party websites.
13.5. By agreeing to be bound by the terms of this Agreement, the User agrees to indemnify, defend, and hold harmless https://www.europehealthagency.com's affiliates, and their respective directors, officers, employees, shareholders, partners, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) incurred due to or in connection with any breach or alleged breach by the User or any person acting on the User's behalf of the terms of this Agreement.
13.6. The Intermediary commits not to disclose any information regarding the Customer's identity to anyone other than the Healthcare Provider, in accordance with the Personal Data Protection Regulation (GDPR). The Customer has no rights or claims to the data shared and processed under the GDPR.
The Intermediary reserves the right to amend these GTC, either wholly or partially, at any time, in consideration of the Customer's interests, in response to new legal circumstances.
Europe Health Agency is not a part of any Europen Association and not related to any legal European Union or Association.
